Brazil Joins South Africa’s ICJ Case Against Israel Over Genocide in Gaza

Brazil (TDI): The Ministry of Foreign Affairs of Brazil announced, on Wednesday, that they are in their “final stages” of submitting a formal intervention to the International Court of Justice (ICJ) regarding the case against Israel for committing genocide and war crimes in Gaza.

It is reported that the case was originally brought by South Africa under the Convention on the Prevention and Punishment of the Crime of Genocide to the ICJ.

“Brazil believes there is no longer room for moral ambiguity or political omission. Impunity undermines international legality and undermines the credibility of the multilateral system”, the Ministry of Foreign Affairs, Brazil said in a statement.

It also added that the international community cannot stay silent anymore in the face of the ongoing crisis. 

The Brazilian government expressed deep concerns at the recurring episodes of violence and war crimes against the civilian population in the State of Palestine, which is not limited to the Gaza Strip but extends to the West Bank.

The civilians in Gaza and the occupied West Bank have been subjected to “recurring episodes of violence” and serious rights violations, including the “shameless use of starvation as a weapon of war”, the Brazilian government said. 

Many other countries, including Turkey, Spain, and Ireland, have also requested to intervene in the case, urging ICJ to state that Israel has been violating the obligations under the 1948 Genocide Convention. 

The Israeli Embassy in Brazil said that the statement from the Brazilian government used “harsh words that do not fully portray the reality of what is currently happening in Gaza”, while Brazil had also “completely ignored” the involvement of Hamas.

The International Court of Justice (ICJ) has yet to rule on whether Israel is committing genocide in Palestine or not, though in its January 2024 ruling, ICJ demanded that Israel prevent genocide by allowing maximum humanitarian aid into Gaza.
